Terms of Use

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Student", "You", "Your") and Konstantin Vavilov ("Provider", "School", "We", "Us", "Our") governing your access to and use of our educational platform, courses, mentorship programs, and personal consultations ("Platform", "School", "Course", "Mentorship", "Personal Consultation", "Services").

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. You agree that you are responsible for compliance with any applicable local laws. If you do not agree to these Terms, you are prohibited from using or accessing this Platform.


1. AGE REQUIREMENTS

1.1. You must be at least 18 years old to independently enroll in a Course, register for a Mentorship, or book a Personal Consultation.

1.2. If you are under 18 years of age, you may enroll in our services only with the express permission and consent of your parent or legal guardian. Your parent or legal guardian must review and agree to these Terms on your behalf and will be responsible for your use of our Services.

1.3. By using our Platform, you represent and warrant that either (a) you are 18 years of age or older, or (b) you have obtained permission from your parent or legal guardian to use our Services and they have agreed to these Terms on your behalf.

1.4. Parents and legal guardians who provide consent for minors to use our Services are responsible for supervising such use, ensuring compliance with these Terms, and are jointly liable for any obligations arising from the minor's enrollment.

2. USE LICENSE

2.1. Permission is granted to temporarily download one copy of any downloadable materials on the Dagger Crown Art Campus's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.

2.2. Under this license, you may not:

  •  Modify or copy the materials
  •  Use the materials for any commercial purpose, or for any public display (commercial or non-commercial)
  •  Remove any copyright or other proprietary notations from the materials
  •  Transfer the materials to another person or "mirror" the materials on any other server
  •  Share Course materials, recordings, or content with non-enrolled individuals
  •  Reproduce, distribute, or create derivative works from our materials

2.3. This license shall automatically terminate if you violate any of these restrictions and may be terminated by the School at any time.

3. ACCOUNT REGISTRATION

3.1. You must provide accurate, current, and complete information during the registration process and maintain the accuracy of such information.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

3.4. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. ENROLLMENT AND PAYMENT

4.1. By enrolling in a Course, registering for Mentorship, or booking a Personal Consultation, you agree to pay all applicable fees as specified at the time of registration.

4.2. Payment Terms: All fees must be paid in full before access to Course materials is granted or before scheduled Mentorship sessions or Personal Consultations take place, unless otherwise specified in a payment plan agreement.

4.3. Currency and Taxes: All prices are stated in the currency specified on the Platform. You are responsible for any applicable taxes, duties, or fees associated with your purchase.

4.4. Payment Methods: We accept payment methods as displayed on the Platform. By providing payment information, you represent that you are authorized to use the payment method provided.

4.5. Service-Specific Terms: 

  • Courses: Access is granted for the duration specified in the Course description
  • Mentorship: Sessions are scheduled based on availability and the selected mentorship package
  • Personal Consultations: Appointments must be booked in advance and are subject to availability
5. REFUND POLICY AND COURSE TRANSFER

5.1. Payment Transfer to Next Course Cohort or Rescheduling

5.1.1. If the Student experiences unforeseen circumstances (family circumstances, health-related problems, or other compelling reasons) that prevent course completion or attendance at scheduled Mentorship sessions or Personal Consultations, the Student has the right to request the Provider to transfer their payment to the next course cohort or reschedule their sessions.

5.1.2. The decision to transfer or reschedule is made by the Provider on a case-by-case basis at the Provider's sole discretion. The Student must submit a written request stating the reasons for the transfer/rescheduling and providing supporting documentation.

5.1.3. Upon approval:

• Courses: The paid amount is transferred to the next course cohort without additional charges, provided that the Course price has not changed. If the Course price has increased, the Student will be responsible for paying the difference.

• Mentorship and Personal Consultations: Sessions may be rescheduled based on availability without additional charges, subject to the rescheduling policies outlined in Section 6.

5.1.4. Transfer or rescheduling requests must be submitted at least 7 days before the Course start date or scheduled session, or within 14 days of the Course commencement, unless exceptional circumstances apply.

5.2. Refund of Funds

5.2.1. Course Refund Policy: Students are eligible for a full refund within 14 days of their initial payment for Course purchases. To request a refund, Students must submit a written request within the 14-day period.

5.2.2. Mentorship and Personal Consultation Refund Policy: All sales of Mentorship programs and Personal Consultations are final. No refunds will be provided for Mentorship or Personal Consultation services under any circumstances, except in cases where the Provider cancels the service as specified in Section 5.2.3.

5.2.3. Provider Cancellation: A full refund is provided if the Course is cancelled by the Provider/School, or if a Mentorship program or Personal Consultation is cancelled by the Provider, regardless of when the cancellation occurs.

5.2.4. Processing Time: Approved refunds are processed within 14 business days from the approval of the refund request, using the same payment method used for the original payment.

5.2.5. No Refund After 14-Day Period: For Courses, no refunds are provided after the 14-day period from initial payment, including but not limited to cases of the Student's withdrawal for personal reasons, non-attendance, dissatisfaction with Course content, or failure to complete the Course.

5.2.6. Non-Refundable Fees: Any third-party service fees are non-refundable under all circumstances.

5.3. Partial Refund

5.3.1. Partial refunds are not provided, except in cases explicitly stated in this Terms of Use or by mutual written agreement of the Parties.

5.3.2. Promotional discounts and special pricing are non-refundable and non-transferable.

6. ATTENDANCE, SESSIONS, AND SCHEDULING

6.1. Course Attendance and Make-Up Sessions

6.1.1. Instructor Absence: If the instructor misses a live Course session due to unforeseen circumstances (illness, emergency, technical difficulties, or other valid reasons), the session will be made up by scheduling a replacement session at a mutually convenient time.

6.1.2. Student Absence: If a Student misses a live Course session, when available, recorded sessions may be provided as an alternative.

6.1.3. No refunds or credits will be provided for missed sessions.

6.1.4. Notification Requirements: Students must notify the Provider at least 48 hours in advance of a known absence to be eligible for a make-up session. Emergency absences will be considered on a case-by-case basis.

6.1.5. Instructor’s Feedback Absence: If the instructor misses a live Feedback session due to unforeseen circumstances (illness, emergency, technical difficulties, or other valid reasons), the session will be rescheduled according to the course program.

6.2. Mentorship Sessions

6.2.1. Mentorship sessions must be scheduled in advance based on mutual availability between the Student and mentor.

6.2.2. Rescheduling by Student: Students may reschedule a Mentorship session by providing at least 48 hours' notice. Failure to provide adequate notice may result in forfeiture of that session.

6.2.3. Rescheduling by Mentor: If a mentor needs to reschedule, the Student will be notified as soon as possible and an alternative time will be arranged.

6.2.4. No-Show Policy: If a Student fails to attend a scheduled Mentorship session without prior notice, the session will be considered completed and no make-up or refund will be provided.

6.2.5. Session Duration: Each Mentorship session duration is as specified in the selected mentorship package and will not be extended for late arrivals.

6.3. Personal Consultations

6.3.1. Personal Consultations must be booked in advance through the Platform, subject to availability.

6.3.2. Cancellation by Student: Students may cancel or reschedule a Personal Consultation by providing at least 48 hours' notice. Cancellations with less than 48 hours' notice will result in forfeiture of the consultation fee.

6.3.3. Cancellation by Provider: If the Provider needs to cancel a Personal Consultation, the Student will receive either a full refund or the option to reschedule at no additional charge.

6.3.4. No-Show Policy: If a Student fails to attend a scheduled Personal Consultation without prior notice, the consultation fee is forfeited and no refund will be provided.

6.3.5. Consultation Duration: Personal Consultations are limited to the time duration specified at booking and will not be extended for late arrivals.

7. COURSE ACCESS AND MATERIALS

7.1. Upon enrollment and payment, you will receive access to Course materials according to a scheduled release timeline. Course content is delivered progressively over the duration of the Course, with new materials becoming available at predetermined intervals as specified in the Course description.

7.2. All Course materials, including videos, audio, written content, documents, presentations, and other content, are the intellectual property of the Provider or its licensors and are protected by applicable copyright and trademark law.

7.3. Access to Course materials is provided for a period of 2 months from the Course start date, unless otherwise specified in the Course description.

8. STUDENT CONDUCT

8.1. You agree to use the Platform and participate in Courses, Mentorship programs, and Personal Consultations in a respectful, ethical, and lawful manner.

8.2. You may not:

  • Harass, threaten, or intimidate other Students, instructors, mentors, or staff
  • Share inappropriate, offensive, or illegal content
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Use the Platform or Services for commercial purposes without written permission
  • Impersonate any person or entity
  • Record Course Live sessions, Mentorship sessions, or Personal Consultations without express written consent from all parties

8.3. Violation of conduct policies may result in immediate suspension or termination of your account and access to all Services without refund.

9. DISCLAIMER

9.1. The materials on the School's website are provided "as is". The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9.2. The School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

9.3. Educational Outcomes: We do not guarantee specific educational outcomes, career advancement, or any particular results from Course or Mentorship Program completion.

9.4. Platform Availability: The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

10. LIMITATIONS OF LIABILITY

10.1. In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School's website, even if the School or an authorized representative of the School has been notified orally or in writing of the possibility of such damage.

10.2. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

10.3. Technical Issues: We are not liable for interruptions, errors, or technical difficulties that may affect your access to the Platform or Course materials.

10.4. Maximum Liability: To the maximum extent permitted by law, our total liability to you for all claims arising from your use of the Platform shall not exceed the amount you paid for the Course in question.

11. REVISIONS AND ERRATA

11.1. The materials appearing on the School's website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its website are accurate, complete, or current.

11.2. The School may make changes to the materials contained on its website at any time without notice. The School does not, however, make any commitment to update the materials.

12. COURSE CHANGES, SERVICE MODIFICATIONS, AND CANCELLATIONS

12.1. We reserve the right to modify Course content, schedules, instructors, mentors, or format at any time. We also reserve the right to modify Mentorship programs and Personal Consultation offerings.

12.2. If we cancel a Course, Mentorship program, or Personal Consultation, you will receive a full refund as specified in Section 5.2.

12.3. We are not liable for any costs or damages resulting from Course modifications, service changes, or cancellations beyond the refund amount.

13. LINKS TO THIRD-PARTY WEBSITES

13.1. The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site.

13.2. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.

14. INTELLECTUAL PROPERTY RIGHTS

14.1. All content on the Platform, including text, graphics, logos, images, audio, video, and Course materials, is owned by the Provider or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

14.2. Any unauthorized use of the Platform's content may violate copyright, trademark, and other laws and may result in legal action.

15. PRIVACY AND DATA PROTECTION

15.1. Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference.

15.2. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

15.3. We implement reasonable security measures to protect your personal information, but we cannot guarantee absolute security.

16. TERMINATION

16.1. We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including but not limited to breach of these Terms.

17. MODIFICATIONS TO TERMS OF SERVICE

17.1. The School may revise these Terms of Service for its website at any time without notice.

17.2. By using this website you are agreeing to be bound by the then current version of these Terms of Service.

17.3. Your continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms.

17.4. We will make reasonable efforts to notify you of material changes to these Terms.

18. DISPUTE RESOLUTION

18.1. In the event of any dispute, you agree to first contact us to attempt to resolve the dispute informally.

19. GOVERNING LAW

19.1. These Terms of Service shall be governed by and construed in accordance with the laws of the School Owner's home jurisdiction in the United States of America.

20. GENERAL PROVISIONS

20.1. These Terms constitute the entire agreement between you and the Provider regarding your use of the Platform.

20.2. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

20.3. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

20.4. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.

21. ACKNOWLEDGMENT

By using the Platform, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them. If you do not agree to these Terms, you must not use the Platform or our Services.
